Limited Warranty

All Plants installed by AUSTIN GARDENS LANDSCAPE will be warranted to be alive, true to name, and free of disease and insect infestation.

Trees will be guaranteed for one (1) year from the date of installation. All shrubs and ground covers shall be warranted for three (3) months from the date of planting.

This warranty is limited to plants supplied and planted by AUSTIN GARDENS LANDSCAPE. Replacements will be made only if AUSTIN GARDENS LANDSCAPE is notified prior to the warranty deadline. Transplanted trees, shrubs, and ground covers are not covered by this warranty.

Replacements will be made with plants of the same type and size.

Determination of a plant or tree's condition shall be certified and noted, in writing if required, by AUSTIN GARDENS LANDSCAPE and/or two (2) Texas Certified Nurserymen. Only one replacement is customary. Additional replacements may indicate a more serious problem.

Plants not covered under this Warranty include bare-rooted trees, sod and grass, vegetables, seeds, and annual or perennial flowers.

The Homeowner agrees to water properly and to keep free from insects and/or diseases. This Warranty does not cover damage due to fire, freezing, drought, or other acts of God, such as rainstorms, lightning, or hail; nor does it cover theft, abuse, or vandalism.

Non-payment of invoices shall potentially void all Warranties.

AUSTIN GARDENS LANDSCAPE will not be responsible for damage to underground utilities or irrigation systems unless they are clearly and correctly marked by the Homeowner.
